When you visit our website www.hermesgiebler.com the browser on your device automatically sends information to the server at our website. This information is temporarily stored in a so-called log file. The following information is recorded without any action on your part and stored until it is automatically deleted:

·           the date and time of the request,

·           name and URL of the accessed website,

·           referrer URL (the previously visited page),

·           browser type and version as well if necessary the user’s operating system as the name of your requesting provider.

 

The specified data will be processed by us for the following purposes:

The legal basis for this data processing is provided by Article 6 Paragraph 1 Sentence 1 lit. f of the EU General Date Protection Regulation (GDPR). Our legitimate interest follows from the data collection purposes listed above. Under no circumstances do we use collected data in order to draw conclusions about you personally.

 

In addition, we use cookies and analytical services when you visit our website. You can find more detailed information in this regard under Section 4 and 5 of this privacy statement.

 

3.      Disclosure of Information

 

Your personal data will only be transmitted to third parties if:

 

·           you have given your express consent in accordance with Article 6 Paragraph 1 Sentence 1 lit. a of the EU General Data Protection Regulation (GDPR),

·           the disclosure in accordance with Article 6 Paragraph 1 Sentence 1 lit. f of the EU General Date Protection Regulation (GDPR) is required in order to establish, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,

·           in the event that a legal obligation obtains for disclosure in accordance with Article 6 Paragraph 1 Sentence 1 lit. c of the EU General Date Protection Regulation (GDPR) and

·           this is legally permissible and required for processing contractual relationships with you in accordance with Article 6 Paragraph 1 Sentence 1 lit. b of the EU General Date Protection Regulation (GDPR).

 

4.      Cookies

 

We use cookies on our site. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do no damage to your end device and they do not contain viruses, Trojans or other malware.

5.      Analytical Tools

 

The tracking measures listed below and used by us are implemented out on the basis of Article 6 Paragraph 1 Sentence 1 lit. f of the EU General Date Protection Regulation (GDPR). With the tracking measures employed, we aim on the one hand to ensure that our website is designed to meet requirements and is constantly enhanced. On the other hand, we use tracking measures to statistically record use of our website and to evaluate it in order to optimize our offer. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

(i)     Google Analytics

 

We use Google Analytics, a web analysis service provided by Google Inc., for the purpose of adequate design and continuous optimization of our pages. In this context user profiles are created under pseudonym and cookies (see Section 4) are used. The information generated by the cookie about your use of the website such as

·           operating system,

·           referrer URL (the previously visited page),

·           host name of the accessing computer (IP address),

·           time of the server request,

 

are transferred to a Google server in the USA and stored there. The information is used to evaluate use of the website, to compile reports on website activities and to provide further services associated with use of the website and the Internet for the purposes of market research and adequate design of these Internet pages. This information may also be transferred to third parties if required by law or if third parties are commissioned to process such data. Under no circumstances do we combine your IP address with other Google data. The IP addresses are anonymized so that any assignment is impossible (IP masking).

(ii)    Google Adwords Conversion Tracking

 

To statistically record the use of our website and for the purpose of optimizing our website, we also use Google Adwords Conversion Tracking. Google Adwords places a cookie (see Section 4) on your computer if you have accessed our website via a Google ad.

 

These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer’s website and the cookie has not yet expired, then Google and the Adwords customer can detect that the user clicked on the ad and was redirected to this page.

 

Each Adwords customer receives a different cookie. Thus cookies cannot be traced via the websites of Adwords customers. The information collected using the conversion cookie is used to generate conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers see the total number of users who clicked on their ad and were redirected to a page with a conversation tracking tag. However, they do not receive any information that personally identifies users.

 

If you do not wish to participate in the tracking process, then you can refuse placement of the cookie required for this purpose – for example, by using a browser setting that generally deactivates automatic placement of cookies. We are using the open source web analysis tool Matomo for the analysis and statistical evaluation of the use of our website. For this purpose we use cookies (see Section 4). These data are transferred to our server and can be used to create pseudonymized use profiles. This information will be used to optimize our website based on the needs of its users. This information will not be transmitted to third parties.

 

Under no circumstances do we combine your IP address with other personal data. The IP addresses are anonymized so that any identification is impossible (IP masking).

·           to request erasure of your personal date stored with us in accordance with Article 17 of the EU General Data Protection Regulation (GDPR), unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to establish, exercise or defend legal claims;

·           in accordance with Article 18 of the EU General Data Protection Regulation (GDPR), to restrict the processing of your personal data if you contest the accuracy of the data, if the processing is unlawful but you oppose erasure of the data and we no longer need the data, but you require the data in order to establish, exercise or defend legal claims or if you have filed an objection to processing in accordance with Article 21 of the EU General Data Protection Regulation (GDPR);

If your personal data are processed on the basis of legitimate interests in accordance with Article 6 Paragraph 1 Sentence 1 lit. f of the EU General Date Protection Regulation (GDPR), then you have the right to object to the processing of your personal data pursuant to Article 21of the EU General Date Protection Regulation (GDPR), provided that there are grounds relating to your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right of objection, which we will implement without specification of a particular situation.

8.      Data Security

 

We use the widely employed SSL procedure (Secure Socket Layer) in connection with the respectively highest level of encryption supported by your browser within the scope of the website visit. Usually this is 256-bit encryption. If your browser does not support 256-bit encryption, then we use 128-bit v3 technology instead. Whether a single page of our website is transmitted in encrypted form is indicated by the display of the closed key or lock symbol in the lower status bar of your browser.

 

We also use suitable technical and organizational security measures in order to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties.
